New Home Affairs Minister Extends Temporary Concession for Foreign Nationals in South Africa

Leon Schreiber, the newly sworn-in Minister of Home Affairs, has extended a temporary concession for foreign nationals residing in South Africa, allowing them to remain in the country until 31 December 2024.

This decision comes after the expiration of the previous extension, which left many in uncertainty about their legal status.

The extension applies to various categories of foreign nationals, including those awaiting the outcomes of visa applications, waivers, and appeals.

Here are the key details:

  • Long-term Visa Holders: Foreign nationals with pending visa applications as of 30 June 2024 will receive a temporary extension until the end of the year. They are permitted to stay in South Africa without engaging in activities beyond their visa conditions. They can also exit and re-enter the country until 31 December 2024 without being declared undesirable.
  • Waiver Applications: Applicants with pending waiver applications as of 30 June 2024 can also stay in South Africa until the end of 2024. They are allowed to travel out of the country with a waiver application receipt and re-enter without a declaration of undesirability. Non-visa-exempt applicants must apply for a port of entry visa for re-entry.
  • Appeal Applicants: Those who have appealed a negative decision on a long-term visa application will receive an extension until 31 December 2024. They can exit and re-enter with an appeal application receipt, provided they apply for a port of entry visa if necessary.
  • Short-term Visa Holders: Applicants awaiting renewal of short-term visas must exit South Africa within 90 days from the expiry date of their principal visa to avoid being declared undesirable. This aligns with regulations limiting short-term stays to 180 days.

Minister Schreiber emphasized that any further changes to these provisions will be communicated in writing before 31 December 2024. This move aims to address administrative inefficiencies and enhance South Africa’s appeal for international talent, investment, and tourism.

The extension underscores the Minister’s commitment to safeguarding applicants and ensuring clarity in immigration processes, thereby supporting economic growth and job creation in the country.
